Medical Malpractice
When we go to the hospital, emergency room or walk-in clinic in New York, we trust the health care providers there with our lives and/or with the well-being of our loved ones. Typically, we turn to doctors, nurses and other medical professionals when we most need help. Unfortunately, while the vast majority of people in our state can count on getting ample care, accidents and
negligence do occur.
A patient could fall out of an improperly secured hospital bed, causing serious injury. An unattended resident could
wander off or suffer a
slip and fall accident in a nursing home or assisted living facility. A surgeon could make an error during a routine procedure. A doctor could even misdiagnose a serious disease like cancer, leading to the death of a mother, father or child.
In New York, patients have
rights under the law. When a licensed healthcare provider causes injury or death of a patient, legal action should be taken.
New York medical malpractice claims often result from:
- Delay or failure to diagnose
- Slip and fall accidents
- Prescription drug errors
- Anesthesia errors
- Improper consent
- Surgical errors
- Improper treatment of an illness or disease
- Birth injuries
- Experimental therapy
Medical malpractice claims in New York can often lead to complex litigation. Mitigating circumstances or statutes of limitations may apply. If you're injured or a family member is injured or killed through the fault of a health care provider you need an attorney who not only knows the law, but understands the intricacies of your case and how to win it.
At Mallilo & Grossman, we've got the experience and the manpower necessary to fight for our clients. We provide our partners and associates with the preparation and guidance most firms don't about how to read and understand documents like medical records, X-Rays and MRIs. We also work closely with medical experts who act as consultants to us on our medical malpractice cases.

Malpractice and neglect in New York nursing homesAccording to statistics from the
Kaiser Family Foundation, there are nearly
650 registered nursing homes and assisted living facilities in New York State, serving more than
105,000 residents. Unfortunately, a
recent article in the New York Times also states that a large number of these facilities overlook or underreport internal problems that "pose a serious, immediate threat to patients."
The Times reported that the
Government Accountability Office found a "widespread ‘understatement of deficiencies,' including
malnutrition, severe
bedsores, overuse of
prescription medications and abuse of nursing home residents," in a nationwide study.
The elderly and disabled residents of assisted living facilities - most of whom are paying high fees to ensure proper care - are among the most vulnerable of our citizens and when they are injured, mistreated or neglected they deserve the best legal help available.
The Kaiser Foundation lists the top ten most common deficiencies in nursing homes as:
- Accident prone environment
- Improper food sanitation
- Poor general quality of care
- Lack of professional standards
- No comprehensive care plans
- Bad housekeeping
- Insufficient incontinence/urinary care
- Bed sores
- Unnecessary drugs
- Unsatisfactory infection control
